SolWeather Membership Terms & Conditions

These Membership Terms & Conditions ("Terms") govern the use of the SolWeather membership service provided by 444 Holdings Pty Ltd ("SolWeather", "we", "our", or "us"). By purchasing a SolWeather membership, you acknowledge that you have read, understood and agree to be bound by these Terms.

The term "SolWeather" includes 444 Holdings Pty Ltd, Dean Archibald McArthur, and any employees, contractors, agents or authorised representatives acting on behalf of SolWeather.

1. Membership Overview

SolWeather provides long-range weather forecasting, rainfall outlooks, weather commentary, forecast maps and related information for Australia through a subscription-based membership service.

Membership provides access to proprietary forecasting information intended to assist users in making informed planning and business decisions.

Membership is intended for personal or internal business use only and does not transfer any ownership of SolWeather's intellectual property.

2. Membership Commitment

Membership is billed monthly at the current advertised membership rate.

By subscribing, you agree to an initial minimum commitment of twelve (12) consecutive monthly payments.

Your membership commences immediately upon successful payment and provides access to SolWeather's member-only content, including long-range forecasts, forecast maps, commentary and associated services.

Following completion of the initial twelve-month commitment, your membership will automatically continue on a month-to-month basis unless cancelled by you before your next scheduled billing date.

3. Membership Fees & Billing

Membership fees are currently:

$150.00 AUD plus GST per month
($165.00 AUD including GST)

Payments are securely processed through Stripe using your nominated payment method.

Membership fees are charged automatically each month.

If your payment method cannot be successfully processed, SolWeather may:

  • retry the payment;

  • suspend access to member-only content until payment is received; or

  • cancel your membership if payment remains outstanding.

Membership fees may be varied in the future. Where practical, reasonable notice will be provided before any price changes apply to existing members.

4. Automatic Renewal

Following completion of the initial twelve-month commitment, your membership automatically renews each month to ensure uninterrupted access to SolWeather services.

Membership will continue until cancelled by either:

  • the member; or

  • SolWeather,

in accordance with these Terms.

5. Cancellation

The initial twelve-month membership commitment cannot ordinarily be cancelled during the commitment period except where required by Australian Consumer Law.

Following completion of the initial commitment period, you may cancel your membership at any time before your next scheduled billing date.

Cancellation prevents future monthly charges.

Your membership access will remain active until the end of your current paid billing period, after which access to member-only services will cease.

6. Refund Policy

Due to the immediate provision of digital content, proprietary forecasting information and intellectual property upon commencement of membership, membership fees are generally non-refundable.

Refunds will only be provided where required under Australian Consumer Law.

Nothing contained within these Terms limits or excludes any rights you may have under Australian Consumer Law.

7. Member Responsibilities

Members agree to:

  • provide accurate account information;

  • maintain the confidentiality of their login credentials;

  • ensure their account is not shared with others;

  • promptly notify SolWeather of any unauthorised use of their account.

Members are responsible for all activity occurring under their account.

8. Intellectual Property

All forecasts, rainfall maps, graphics, commentary, software, databases, models, research, written material, website content and other information supplied through SolWeather remain the exclusive intellectual property of SolWeather.

Membership grants a limited, revocable, non-exclusive, non-transferable licence to access the service solely for the member's own personal or internal business use.

Members must not:

  • reproduce;

  • redistribute;

  • publish;

  • copy;

  • modify;

  • scrape;

  • screen capture for redistribution;

  • sell;

  • licence;

  • commercially exploit; or

  • otherwise distribute

any SolWeather content without prior written permission.

Unauthorised use may result in immediate termination of membership and legal action where appropriate.

9. Forecast Disclaimer

SolWeather provides long-range weather forecasting based upon proprietary research, historical analysis, scientific interpretation and forecasting methodologies.

While every reasonable effort is made to provide accurate and useful forecasting information, weather forecasting is inherently uncertain.

Accordingly:

  • forecasts may prove inaccurate in whole or in part;

  • forecast accuracy cannot be guaranteed;

  • historical performance does not guarantee future performance.

Members acknowledge that all forecasts are provided for general informational purposes only.

Forecast information should be considered alongside other available information and professional judgement when making operational or financial decisions.

10. Limitation of Liability

To the maximum extent permitted by law, SolWeather excludes all liability for any direct, indirect, incidental, consequential or economic loss arising from:

  • reliance upon forecasts;

  • forecasting inaccuracies;

  • delays;

  • interruptions;

  • website outages;

  • data errors;

  • third-party services;

  • internet failures; or

  • events beyond SolWeather's reasonable control.

Nothing contained within these Terms excludes any liability that cannot legally be excluded under Australian Consumer Law.

11. Suspension or Termination

SolWeather reserves the right to suspend or terminate membership where a member:

  • breaches these Terms;

  • attempts to copy or redistribute member content;

  • engages in fraudulent or unlawful conduct;

  • abuses the service;

  • fails to maintain payment obligations.

Termination under this clause does not affect any outstanding payment obligations.

12. Privacy

Personal information is handled in accordance with SolWeather's Privacy Policy and applicable Australian privacy legislation.

Information is used only for providing membership services, payment processing, customer support and related communications.

13. Changes to Membership or Terms

SolWeather may update these Terms or modify membership features from time to time.

Where changes materially affect existing members, reasonable notice will be provided where practical.

Continued use of the membership following any changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia.

Any disputes arising from these Terms will be subject to the jurisdiction of the courts of Western Australia.

Member Acknowledgement

By purchasing a SolWeather membership you acknowledge that:

  • you have read and understood these Terms;

  • you agree to the initial twelve-month minimum membership commitment;

  • membership renews automatically on a monthly basis after the initial commitment until cancelled;

  • you understand that forecasts are probabilistic in nature and cannot be guaranteed;

  • you agree to use SolWeather services in accordance with these Terms.
